The EU courts will be happy with it as is Germany and its not like their Government can ever be racist ;)

Actually the EU courts will be happy as they are happy with Vignettes in other member states. And the foreign truck charging in Germany (and other countries). Though the truck charging is a pilot for the EU-wide road user charging policy that Brussels keeps pushing for so the EU wouldn't care if it was covered in swastikas...

Wasn't the charging of commercial vehicles (sorry, heavy goods vehicles and buses) directed (at least in part) at such vehicles from Russia?

Maybe, but then they'd have just made it non-EU vehicles, which isn't the case.
