Since no one has seriously addressed the issue - I'm willing to bet the concern is that these vigilantes may not all be using the correct standards for pothole patching. You don't just pour in asphalt - you clean the sides and bottom, you provide the proper asphalt mix at the proper temperature, you compact - requiring machinery that a lot of these people probably don't have. Sure, on first thought, it's great to have more potholes filled, but what you end up with is pothole filler that comes out and shreds tires, shatters windshields, etc. Not fun to have holes around the city, but better to know that the filled ones are safe.

The article made it clear that the "vigilante paver" sometimes did this after completing another private paving job, and had some asphalt left over. And he boasted about the quality of his equipment.
That exact same thing was done by the guy who paved our driveway a month or so ago: he patched a few potholes in the (private) street in our neighborhood.

Even in that case, private paving jobs often use looser standards than what a city would require, so it's still a liability risk for the city.
Since your road is also private, the case for the guy who paved your driveway is not an issue
