Kersey, CO not following State Law

I saw a post on Instagram where a video caption of a reporter ( or the like) was claiming that Kersey town law states that one could fine a driver through a speed camera at $390.  According to state law in Colorado, the fine is $40 on regular roads for being caught on cam and $80 in school or construction areas. 

The announcer stated that the camera is mobile on a road where speed limits decrease from 65 to 45 in a quarter mile and also the fact that city ordances follows the same fines in their ordanance books.  He says to fight the ticket especially if you are in court as it violates both municipal and state laws.

Don't know if that is case or not, but interesting to post. However, Kersey is on US 34, and its a road.

Kersey's a little town outside of Greeley, and in all my years in Colorado, I've probably driven that stretch once. Classic sleepy town speed trap.

Talking about US 34 being a road, not Kersey. For the sake of this forum, speed cameras are a road related topic.

Is the camera signed in advance?

My only time along that highway was just last year.  We were following my parents, and let me just say that I'm glad it wasn't operational at the time.  While I do recall that there was a decent amount of cross-traffic to warrant a speed limit drop, I also recall that the speed zone was too long.

The 9News article says this isn't even on US 34 - it's a stretch of county road NEAR US 34.

Oh, sorry, I forgot that bit, and I didn't look closely at the map when I went to the GSV link.  Now that I'm looking more closely... geez, I don't remember that intersection being noteworthy at all.  And yeah, that's an unnecessary drop to 45 mph right there, and definitely inappropriate to automatically zing people.  A wide open four-lane highway with hardly any driveways.

It actually goes 65 > 55 > 45 > 35 South of the signal, then back up to 55 incrementally north of the signal. A drop to 45 alone would have been more than enough imho...

All speed drops south of US-34 and the cameras are signed. However, the camera uses temporary signs. If you fish around the GSV you can find most of them. :)

It's a pure money grab for a town that doesn't touch WCR 49 until the town annexed only the roadbed in the area where they can increase town revenues.  No doubt there are people who speed on that road and believe me, it's easy to do, but you rarely see a patrol vehicle out there doing what they can to enforce safety, as the town claims it is.  The police chief there makes Chief Wiggum on The Simpsons look competent with his weaker-than-circus-lemonade comments on why this type of enforcement is legitimate and how they arbitrarily decide who tickets get mailed to based on all tickets being reviewed by his top-notch team.  They have paused issuing the $340 tickets, so it seems they realize they may be in violation of state law by doing this.  We'll find out soon enough when someone ends up taking the town to court over this ...
